Stop A Home Repossession

A Possession Order on Your Home A possession order is given by the courts to the lender and has a date stated on it by which you must remove yourself from the property (usually about 4 weeks after the hearing). Up until this date there is still time to stop the repossession. You may be able to appeal to stay longer in your home under circumstances such as ill health. The lender now legally has the right to evict you, however this doesn’t mean that they will. Remember that your mortgage lender would prefer you to stay in the home and make the payments rather than go through the process of repossession. Eviction Advice If you are facing eviction, you need to be aware of the laws that your landlord or lender must follow, otherwise they may be committing a criminal offence. If you are behind on your mortgage repayments, your lender will normally prefer to get the matter resolved rather than repossess the house.
